UKATA Trained Logo
Terms and Conditions of Registration and Use
Effective date: 01/10/2026
Version: 1
These Terms and Conditions govern registration for and use of the UKATA Trained logo (“the Logo”).
By submitting an application, accepting these Terms and Conditions and/or using the Logo following approval, the applicant agrees to be bound by these Terms and Conditions and the applicable UKATA Brand Guidelines.
1. Purpose of the UKATA Trained Logo
1.1 The UKATA Trained Logo is an official UKATA mark intended to provide eligible individuals and organisations with an authorised way of demonstrating that they, or relevant personnel within their organisation, have completed UKATA-approved training.
1.2 The scheme is intended to:
- recognise completion of UKATA-approved training;
- promote the value of UKATA-approved training;
- provide an authorised means of displaying an association with UKATA-approved training;
- protect the integrity and reputation of UKATA and its intellectual property; and
- enable UKATA to control and monitor use of the Logo.
1.3 Registration under the scheme does not constitute UKATA membership unless the individual or organisation separately holds current UKATA membership.
2. Definitions
For the purposes of these Terms and Conditions:
“Applicant” means an individual or organisation applying to participate in the UKATA Trained scheme.
“Authorised User” means an individual or organisation whose application has been approved by UKATA and whose registration remains current.
“Brand Guidelines” means any guidelines, instructions or requirements issued by UKATA governing the display and use of the Logo, as amended from time to time.
“Registration” means UKATA's authorisation for an individual or organisation to participate in the UKATA Trained scheme and use the Logo in accordance with these Terms and Conditions.
“Registration Period” means the period for which Registration has been granted by UKATA.
“Logo” means the UKATA Trained logo and any authorised version or format of it supplied by UKATA.
“UKATA-approved training” means training delivered and certified under the applicable UKATA-approved training arrangements.
3. Eligibility
3.1 Registration is available to:
3.2 Applicants must provide such evidence as UKATA reasonably requires to establish eligibility.
3.3 UKATA reserves the right to determine whether an individual, organisation, course or training record satisfies the eligibility requirements of the scheme.
3.4 Meeting the minimum eligibility criteria does not create an automatic entitlement to Registration. UKATA reserves the right to refuse an application where it reasonably considers that granting Registration could:
- mislead the public;
- adversely affect the integrity of the scheme;
- damage or risk damage to UKATA's name, reputation or intellectual property;
- conflict with the purpose of the scheme; or
- otherwise be inappropriate in the circumstances.
4. Commitment to Appropriate Training
4.1 Authorised Users are expected to support and promote appropriate standards of training and competence.
4.2 Individuals and organisations remain responsible for ensuring that training undertaken is appropriate to the work being performed and that personnel receive training appropriate to their roles and responsibilities.
4.3 Training should remain valid, relevant and up to date throughout the Registration Period where required by the applicable training standard, industry requirements or the nature of the work being undertaken.
4.4 Registration for the UKATA Trained scheme does not remove or replace an individual's or organisation's responsibility to determine what training, competence, supervision, licences, qualifications or other requirements apply to particular work activities.
5. Application and Registration
5.1 Applicants must:
- complete the official UKATA application process;
- provide complete, accurate and current information;
- provide evidence of eligible UKATA-approved training;
- accept these Terms and Conditions;
- comply with any applicable Brand Guidelines; and
- pay the applicable Registration fee.
5.2 UKATA may request additional information or evidence before approving an application.
5.3 UKATA may refuse an incomplete application or an application where information cannot be satisfactorily verified.
5.4 The Applicant is responsible for ensuring that all information supplied to UKATA is true, accurate, complete and not misleading.
5.5 Providing false, altered, fraudulent or misleading information may result in immediate rejection, suspension or withdrawal of Registration and may result in further action where appropriate.
6. Verification of Training and Information
6.1 By applying for Registration, the Applicant authorises UKATA to take reasonable steps to verify information supplied in connection with the application.
6.2 This may include verifying relevant training records with UKATA-approved training providers and other appropriate parties.
6.3 UKATA may undertake further verification during the Registration Period where reasonably necessary to confirm continuing eligibility, investigate a complaint or suspected misuse, or protect the integrity of the scheme.
6.4 Authorised Users must cooperate with reasonable requests from UKATA for information or evidence concerning their Registration or use of the Logo.
6.5 Failure to provide information reasonably requested by UKATA may result in suspension or withdrawal of Registration.
7. Registration Period and Renewal
7.1 Unless otherwise confirmed by UKATA, Registration is valid for 12 months.
7.2 Registration does not renew automatically unless UKATA expressly introduces an automatic renewal arrangement.
7.3 Authorised Users wishing to continue using the Logo must complete the applicable renewal process and pay the relevant fee before or at the expiry of their Registration.
7.4 UKATA may require updated evidence of eligibility as part of the renewal process.
7.5 If Registration is not renewed, the Authorised User's permission to use the Logo will end upon expiry of the Registration Period.
7.6 UKATA is not responsible for an Authorised User's failure to renew Registration, whether or not a renewal reminder has been issued.
8. Fees
8.1 Applicants must pay the Registration fee applicable to their category of Registration.
8.2 Current fees will be communicated by UKATA as part of the application or renewal process.
8.3 Unless UKATA determines otherwise, Registration fees are non-refundable once an application has been approved.
8.4 Where UKATA declines an initial application, the applicable Registration fee will be refunded.
8.5 UKATA reserves the right to amend Registration fees for future Registration or renewal periods.
9. Licence to Use the Logo
9.1 Subject to approval and payment of the applicable fee, UKATA grants the Authorised User a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the Logo during the Registration Period.
9.2 The licence:
- applies only to the Authorised User;
- exists only while Registration remains valid and has not been suspended or withdrawn;
- is subject to these Terms and Conditions and the Brand Guidelines; and
- does not transfer any ownership or other intellectual property rights to the Authorised User.
9.3 No right to use the Logo exists merely because an individual or organisation has completed UKATA-approved training. Use is permitted only following approval under the UKATA Trained scheme.
10. Permitted Use
10.1 Subject to these Terms and Conditions and the Brand Guidelines, an Authorised User may display the Logo on appropriate materials including:
- websites;
- email signatures;
- social media profiles;
- professional networking profiles;
- digital marketing;
- business stationery; and
- promotional materials.
10.2 The Logo must only be used in the form supplied or expressly approved by UKATA.
10.3 The Authorised User must ensure that the context in which the Logo appears is accurate, appropriate and not misleading.
10.4 Use of the Logo must relate to the Authorised User to whom Registration has been granted.
11. Prohibited Use
11.1 The Logo must not be:
- altered, redrawn, distorted, recoloured or otherwise modified except where expressly permitted by the Brand Guidelines;
- incorporated into another logo, trade mark or design;
- transferred, sold, assigned, licensed or sublicensed to another person or organisation;
- supplied to another person or organisation for their use;
- used following expiry, suspension or withdrawal of Registration;
- used in a manner inconsistent with UKATA's Brand Guidelines;
- used in connection with unlawful, fraudulent, dishonest, unethical, misleading or defamatory activity; or
- used in any manner that UKATA reasonably considers could damage the reputation or integrity of UKATA, its members, UKATA-approved training or the UKATA Trained scheme.
11.2 The Logo must not be used to state or imply that:
- the Authorised User is a UKATA member unless separately entitled to make that claim;
- UKATA endorses or recommends the Authorised User, its products or its services;
- UKATA has accredited, approved or certified the Authorised User's business or services;
- UKATA guarantees the quality or safety of work undertaken by the Authorised User;
- the Authorised User holds qualifications, licences, competence or professional status beyond those actually held;
- UKATA accepts responsibility for the Authorised User's work or conduct; or
- all personnel within an organisation are UKATA trained where that is not the case.
12. Organisations and Employees
12.1 An organisation's Registration is granted to the organisation itself and must not be interpreted as confirmation that every employee, worker, contractor, branch, subsidiary or associated organisation has completed UKATA-approved training.
12.2 Organisations must ensure that any statements made alongside the Logo accurately represent the extent and nature of UKATA-approved training within the organisation.
12.3 Organisations remain responsible for ensuring that personnel undertaking activities requiring particular training or competence hold training appropriate to their roles.
12.4 Where an organisation's eligibility depends upon specified trained personnel, the organisation must notify UKATA of material changes that may affect its eligibility, including where relevant trained personnel leave the organisation.
12.5 UKATA may request evidence at any time during the Registration Period to confirm that an organisation continues to satisfy the applicable eligibility requirements.
12.6 Registration does not automatically extend to parent companies, subsidiaries, associated companies, franchisees, contractors or other separate legal entities unless expressly approved by UKATA.
13. Continuing Obligations
13.1 Authorised Users must notify UKATA promptly of any material change that may affect:
- their eligibility;
- the accuracy of information supplied to UKATA;
- their entitlement to use the Logo; or
- information displayed on the UKATA Trained register.
13.2 Authorised Users must ensure that their use of the Logo remains compliant throughout the Registration Period.
13.3 UKATA may periodically review Registration and may request updated information or evidence where reasonably required.
14. UKATA Trained Register
14.1 UKATA may maintain a register of individuals and organisations authorised to use the Logo.
14.2 The register may be made available to the public to enable customers, clients and other interested parties to verify whether an individual or organisation is currently registered to use the Logo.
14.3 Inclusion on the register confirms only the registration status shown by UKATA at the relevant time. It does not constitute an endorsement, recommendation, accreditation or guarantee by UKATA.
14.4 UKATA may remove or amend an entry where Registration expires, is suspended or withdrawn, or where information requires correction.
15. Monitoring, Complaints and Investigation
15.1 UKATA reserves the right to monitor use of the Logo and take reasonable steps to protect its brand and intellectual property.
15.2 UKATA may:
- review publicly available uses of the Logo;
- investigate suspected unauthorised or misleading use;
- investigate complaints;
- request information or evidence from an Authorised User;
- require corrective action;
- require amendment or removal of a particular use;
- temporarily suspend permission to use the Logo while a matter is investigated; and
- take such further action as UKATA considers reasonably necessary to protect its rights and the integrity of the scheme.
15.3 Authorised Users must cooperate reasonably with any investigation concerning their use of the Logo.
16. Suspension and Withdrawal
16.1 UKATA may suspend or withdraw Registration where it reasonably considers that:
- these Terms and Conditions have been breached;
- the Brand Guidelines have been breached;
- eligibility requirements are no longer satisfied;
- training records cannot be verified;
- false, inaccurate or misleading information has been provided;
- applicable fees have not been paid;
- the Logo has been misused;
- an Authorised User has failed to cooperate with a reasonable compliance investigation;
- continued use of the Logo could mislead the public;
- continued use could damage UKATA's reputation, intellectual property or the integrity of the UKATA Trained scheme; or
- there is another reasonable basis for UKATA to conclude that continued Registration is inappropriate.
16.2 Where UKATA considers the matter sufficiently serious, it may suspend permission to use the Logo with immediate effect while an investigation takes place.
16.3 UKATA may require corrective action within a specified period as an alternative to, or prior to, withdrawing Registration.
16.4 Nothing in these Terms requires UKATA to provide a corrective period before suspension or withdrawal where UKATA reasonably considers immediate action necessary to protect the public, UKATA's reputation, its intellectual property or the integrity of the scheme.
16.5 UKATA may refuse a future application or renewal following serious or repeated misuse of the Logo or breach of these Terms and Conditions.
17. Requirement to Cease Use and Remove the Logo
17.1 Upon expiry, suspension, withdrawal or other termination of Registration, the Authorised User's licence to use the Logo immediately ceases, unless UKATA expressly confirms otherwise in writing.
17.2 The individual or organisation must immediately cease using the Logo.
17.3 This includes removing the Logo, as soon as reasonably practicable and in accordance with any deadline specified by UKATA, from all materials within the Authorised User's control, including:
- websites;
- social media accounts and profiles;
- email signatures;
- digital advertisements;
- electronic documents;
- templates;
- presentations;
- marketing materials;
- online directories or profiles controlled by the Authorised User; and
- other digital or physical materials specified by UKATA.
17.4 UKATA may issue reasonable instructions concerning printed materials, signage, stock or other physical items bearing the Logo.
17.5 Where requested, the former Authorised User must provide reasonable evidence to UKATA demonstrating that use has ceased and the Logo has been removed.
17.6 An Authorised User must not deliberately delay removal, continue using existing materials in order to exhaust stock, or otherwise continue displaying the Logo following expiry, suspension or withdrawal unless UKATA has expressly authorised this in writing.
18. Unauthorised Use and Enforcement
18.1 Use of the Logo without current UKATA authorisation, or following expiry, suspension or withdrawal of Registration, constitutes unauthorised use.
18.2 The Authorised User acknowledges that unauthorised use of UKATA's trade marks or other intellectual property may cause harm to UKATA for which financial compensation alone may not always provide an adequate remedy.
18.3 Where unauthorised use occurs, UKATA reserves all rights and remedies available to it, including where appropriate:
- requiring immediate cessation and removal;
- issuing formal legal correspondence;
- pursuing injunctive or other court relief;
- seeking damages or other financial remedies;
- seeking recovery of legal costs where legally recoverable;
- reporting unlawful or misleading activity to appropriate authorities or platforms; and
- taking such other enforcement action as UKATA considers appropriate.
18.4 Nothing in these Terms and Conditions restricts or waives any statutory, common-law or other rights available to UKATA as owner of the Logo or other UKATA intellectual property.
18.5 UKATA's decision not to take immediate action in relation to a particular breach does not constitute permission for continued use and does not prevent UKATA from enforcing its rights subsequently.
19. Intellectual Property
19.1 The Logo and associated UKATA trade marks, designs, branding and intellectual property are owned by or licensed to UKATA.
19.2 All goodwill arising from an Authorised User's use of the Logo shall accrue to UKATA.
19.3 Registration gives the Authorised User only the limited licence described in these Terms and Conditions.
19.4 No ownership interest or other proprietary right in the Logo is transferred to an Authorised User.
19.5 An Authorised User must not:
- apply to register the Logo or a confusingly similar mark;
- claim ownership of the Logo;
- challenge UKATA's ownership or rights in the Logo; or
- use or register any mark, domain name, business name, social-media identifier or other designation that is likely to cause confusion with UKATA or the UKATA Trained scheme.
20. No Certification, Endorsement or Guarantee
20.1 Registration confirms only that the applicable eligibility requirements for the UKATA Trained scheme have been satisfied at the relevant time.
20.2 Registration and display of the Logo do not constitute a certification, accreditation, endorsement, recommendation or guarantee by UKATA of:
- an individual's ongoing competence;
- an organisation's competence;
- the quality of work or services provided;
- compliance with legislation or regulatory requirements;
- suitability to undertake a particular activity;
- health and safety performance; or
- any product or service supplied by the Authorised User.
20.3 Responsibility for competence, legal compliance, safe working practices and the quality of work remains with the individual, organisation, employer, dutyholder or other relevant party as applicable.
21. Liability
21.1 Nothing in these Terms and Conditions excludes or limits liability where such liability cannot lawfully be excluded or limited.
21.2 Subject to clause 21.1, UKATA does not accept responsibility for representations made by an Authorised User concerning its Registration or use of the Logo.
21.3 UKATA is not responsible for losses arising from:
- an Authorised User's misuse of the Logo;
- reliance by a third party upon statements or representations made by an Authorised User;
- suspension or withdrawal resulting from a breach of these Terms and Conditions; or
- an Authorised User's failure to renew Registration.
21.4 Authorised Users remain responsible for ensuring that their use of the Logo and statements made in connection with it are accurate, lawful and not misleading.
22. Indemnity
22.1 To the extent permitted by law, the Authorised User shall indemnify UKATA against claims, losses, liabilities, damages, costs and expenses reasonably incurred by UKATA arising directly from:
- the Authorised User's unauthorised or misleading use of the Logo;
- a material breach of these Terms and Conditions;
- false or misleading representations made by the Authorised User concerning UKATA, Registration or the Logo; or
- infringement of a third party's rights caused by the Authorised User's manner of using the Logo.
22.2 This clause does not apply to the extent that a loss results from UKATA's own negligence or unlawful act.
23. Data Protection and Public Register
23.1 UKATA will process personal data obtained through the application, registration, verification and administration of the UKATA Trained scheme in accordance with applicable data-protection legislation and UKATA's Privacy Policy.
23.2 Applicants acknowledge that specified registration information may be published on the UKATA Trained register for the purpose of confirming whether an individual or organisation is currently authorised to use the Logo.
23.3 The information to be displayed publicly, the purposes for which personal data is processed, applicable lawful bases, retention arrangements and individuals' data-protection rights will be explained in UKATA's applicable Privacy Policy and/or privacy information provided during the application process.
23.4 Applicants must not provide UKATA with personal data relating to another individual unless they are authorised to do so and have complied with any applicable data-protection obligations.
24. Changes to These Terms and the Scheme
24.1 UKATA may amend these Terms and Conditions, the Brand Guidelines, eligibility criteria or operation of the UKATA Trained scheme from time to time.
24.2 Where a change materially affects an existing Authorised User's rights or obligations, UKATA will take reasonable steps to communicate the change.
24.3 UKATA may specify the date upon which amended terms take effect.
24.4 Continued use of the Logo after amended Terms and Conditions have taken effect will constitute acceptance of those amended terms, subject to applicable law.
24.5 Where an Authorised User does not accept a material amendment, they must cease using the Logo and notify UKATA.
25. Communications and Notices
25.1 Applicants are responsible for providing UKATA with current and accurate contact information.
25.2 UKATA may communicate with an Applicant or Authorised User using the contact details provided during application or subsequently updated.
25.3 Authorised Users must notify UKATA of relevant changes to their contact information.
26. Relationship with Brand Guidelines
26.1 These Terms and Conditions must be read together with the applicable UKATA Trained Brand Guidelines.
26.2 Authorised Users must comply with both documents.
26.3 If there is an inconsistency between these Terms and Conditions and the Brand Guidelines concerning the legal right to use the Logo, these Terms and Conditions shall take precedence.
27. No Transfer or Third-Party Rights
27.1 Registration is personal to the approved individual or organisation and may not be assigned, transferred, sold or sublicensed.
27.2 Except where expressly stated otherwise, no person other than UKATA and the Applicant or Authorised User shall have any right to enforce these Terms and Conditions.
28. Severability
28.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as modified to the minimum extent necessary to make it valid and enforceable where possible.
28.2 The remaining provisions shall continue in full force and effect.
29. Waiver
29.1 Any failure or delay by UKATA in exercising a right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy.
29.2 A waiver relating to one breach does not constitute a waiver of any subsequent breach.
30. Entire Agreement
30.1 These Terms and Conditions, together with the applicable application requirements and Brand Guidelines, constitute the agreement governing Registration and use of the Logo.
30.2 Nothing in this clause limits liability for fraud or fraudulent misrepresentation.
31. Governing Law and Jurisdiction
31.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, their subject matter, the UKATA Trained scheme or use of the Logo shall be governed by the laws of England and Wales.
31.2 Subject to any rights that cannot lawfully be excluded, the courts of England and Wales shall have jurisdiction in relation to any such dispute or claim.
32. Acceptance
32.1 By submitting an application for Registration, the Applicant confirms that:
- the information provided in the application is true, accurate and complete;
- they have read and understood these Terms and Conditions;
- they have read the applicable UKATA Trained Brand Guidelines;
- they agree to comply with these Terms and Conditions and the Brand Guidelines;
- they understand that permission to use the Logo is conditional and revocable;
- they understand that the Logo must cease to be used following expiry, suspension or withdrawal of Registration; and
- where applying on behalf of an organisation, they have authority to accept these Terms and Conditions on behalf of that organisation.
32.2 The Applicant's agreement to these Terms and Conditions through UKATA's online application process shall constitute acceptance of these Terms and Conditions.
